AN ORDINANCE PROVIDING FOR RESTRICTIONS ON DIGGING IN CITY STREETS OR ALLEYS

Section 1.

Before digging or excavating in any City street, alley, sidewalk, or public right-of-way, a person shall notify the City of Mazeppa through the City’s Public Works Director at least 24 hours in advance of such digging or excavation.

Section 2.

Within 30 days following such digging or excavation, the person shall restore the street or alley to the condition the street or alley was in prior to the digging or excavation. Such repair shall include cutting out and tamping down the soil in the area of the digging or excavation to City specifications as expressed by the City Public Works Director.

Section 3.

In the event that the City is not notified prior to such digging or excavation, or in the event that the service of the street or alley is not restored to its original conditions within 30 days following such digging or excavation, then in that event, the City shall complete the work necessary to restore the street or alley to its original condition and shall bill the person who did the digging or excavation for all costs thereof. If not paid within 30 days, the City may specially assess the same pursuant to Minnesota Statutes Chapter 429 and certify the cost thereof to the County Auditor for collection with the real property taxes.
